I'm having trouble finding details but it appears there definition of "mountaineering" is very wide and includes even people out for a daytime stroll. Reading between the lines (or those that I can find!) it looks as if having a satellite communicator will help you to be looked upon favourably.

I think there was some criticism of the authorities and this is their knee-jerk overreaction. The PLB I have (McMurdo FastFind) doesn't communicate in any way with the satellites or broadcast a position unless you fire it up in an emergency.It does fit in with their general philosophy re the relationship between the authorities and the public, though.
